2- SUBJECT OF THE CONTRACT

The Subject of this hereby Contract is determination of the rights and obligations of the parties in relation to sales and delivery of the product ordered in electronic media by BUYER on SELLER's website shop.gulsha.com, qualifications and sales price of which are specified in this hereby Contract.

3- PRELIMINARY INFORMATION

a) Main features of the good subject to the Contract:

Type, Quantity, Brand/Model, Color, Taxes-Included Sales Price (Except for the domestic customs duties prescribed by the local custom authorities of the Buyer this kind of duties shall born by the Buyer)  (in pcs. x unit price) of the products are as follows.

4- RIGHT OF WITHDRAWAL

We hereby undertake that, consumer has the right of withdrawal from the contract by rejecting the goods or services within fourteen days following the date of receipt of the same, without showing any reason and without paying any penalty clause, and to receive the goods back starting from the date of receipt by seller/provider of the notice of withdrawal.

In order that the return procedures can be made, you are required to send a message to info@gulsha.com before sending the product you want to return, under the message subject of "Product Return Request", together with the order number. Notifications made by invalid means, proof of which is arguable, such as telephone, fax and e-mail, shall be deemed not to have been made.  Pursuant to your return request, our company shall send you a confirmation that your return request is received by us.

5- PROVISIONS FOR EXERCISE OF RIGHT OF WITHDRAWAL AND RETURN OF PRODUCT

5.1. Return of the products which are non-invoiced and unpacked from their original package cannot be made.

5.2. Return of the products which are unpacked from their original package,  which have lost their re-salability, used, decayed, or which are in a condition not purchasable by another customer, or which are destroyed, is not accepted.

5.3. Your products that you want to return are required not to have lost their re-salability, not to have been damaged, to be unused, to be sent together with all their accessories, to be sent together with all their gift items, if any, and all their accessories, and boxes, bags, labels and packages of the products are required not to have been lost or deformed.

5.4. Together with the product you want to return, you are required to send the original invoice and all copies of it in your possession and your return tracking number, and fill in and send the return form. Before sending the product, the customer must make a Return Application by filling in the Return Form, and it must not send the product before its application is approved. Products sent in this way shall not be accepted by our company, and they shall be returned back. Pursuant to your return request, our company shall send you a confirmation that your return request is received by us.

5.5. Buyer shall return the products by its local post office and the courier fee and all expenses for shipment shall be covered by buyer.

5.6.Return of cosmetics products is possible in case the products are maintained in accordance with the return terms and conditions.

5.7. Received products are first examined by gulsha. In case they are in compliance with the above conditions, the return procedure is commenced. When the return is approved, the product price shall be refunded to your bank card or credit card within the legal period of 14 days. This period starts with receipt by gulsha of the notice of withdrawal. Period of transfer of the refunded price into your account is at the initiative of your bank.

5.8. The Customer is obliged to return the product back in the same condition when it was delivered, and in case any use is in question, to indemnify the loss in commercial value of the good due to use.

5.9. It must be pointed out that, only those products purchased on store.gulsha.com shall be able to be returned and replaced.

6- MISCELLANEOUS

6.1.Applications for complaints and objections shall be able to be made to the consumer arbitration board or consumer court at the place where the consumer transaction is made (Turkey), in accordance with the monetary limitations determined by the Ministry Customs and Trade every year in December.

6.2. In case the parties change their addresses they have specified during signature of this contract, they have the obligation to immediately notify in written their new notification addresses, with a return receipt requested certified mail clearly indicating that it is intended for address change. Otherwise, notifications made to the former address shall be deemed valid in accordance with the legal legislation.

6.3. Sales of the product subject to this hereby contract made by SELLER, is aimed at the end user. In case Seller has a suspicion that BUYER has purchased the product for the purpose of reselling, or identifies indications in this respect, it may terminate the contract unilaterally and for just cause.

6.4. Stamp duty for this hereby contract shall be borne by SELLER.

6.5. BUYER accepts and declares that the BUYER is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of Turkey may be subject to import taxes, customs duties and fees levied by the destination country. BUYER may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the BUYER's country. Additional charges for customs clearance must be fulfilled by the BUYER; SELLER has no control over these charges, nor can SELLER predict what they may be.

6.6. Information provided in this hereby contract have been given for commercial purposes, in consistency with the remote communication devices used, under the good faith principles, and in a way to protect the non-adults and adults who are deprived of or restricted from the ability of distinction.

7- BUYER'S DECLARATION

BUYER declares that, it has read and become informed of the preliminary information in article 3 of this hereby Contract including all the information in respect of the main features, sales price, mode of payment and delivery of the product subject to the Contract, and it has given the necessary confirmation in electronic environment.

8- JURISDICTION CLAUSE

For any disputes which might arise between SELLER and BUYER under this hereby contract, RULES OF LAW OF TURKISH REPUBLIC shall apply, and ISTANBUL ANATOLIAN COURTS AND BAILIFF’S OFFICES and arbitration boards or consumer courts shall have jurisdiction for resolution of disputes.

9- PLACE AND DATE OF SIGNATURE

This hereby Distant Sales Contract has been concluded on {_date_} in electronic environment, and a copy of it has been sent to BUYER's e-mail address specified in article 1 of this hereby contract.

INFORMATION ON store.gulsha.com RETURN TERMS AND CONDITIONS AND PROCEDURES:

You may return the product/products that you have purchased through the website store.gulsha.com, within 14 days following the day when you have taken the delivery of your order, by exercising your RIGHT OF WITHDRAWAL, WITHOUT ANY REASON AND WITHOUT PAYING FOR ANY PENALTY CLAUSE.   Your products that you want to return are required not to have lost their re-salability, not to have been damaged, to be unused, to be sent together with all their gift items, if any, and all their accessories, and boxes, bags, labels and packages of the products are required not to have been lost or deformed. In order to return the product, you are required to fill in the form on shop.gulsha.com, and send the product back to us to our below-specified address within 14 days following the day when you have taken the delivery of your order, in its original package and together with its invoice.

Pack the products carefully in order for them not to be damaged during shipment.

After your returned cargo is received by us and after the product is controlled for compliance with the return terms and conditions, your return procedure shall be affected within 48 hours.

When the return is approved, the product price shall be refunded to your bank card or credit card within the legal period of 14 days. This period starts upon receipt by gulsha of the withdrawal notice, and period of transfer of the refunded price into your account is at the initiative of your bank. For this reason, gulsha is not responsible for the delays arising from the bank, although the price is refunded in due time.

In payments made with bank transfer, please specify in the e-mail that you send regarding that you want to get a return approval, the bank details that the product price will be refunded.
